SERVICES

With the registration and confirmation of registration, a travel contract is concluded on the basis of the travel advertisement stated in the brochures or Internet information. The registration can be made verbally, in writing, by telephone or by e-mail. The cruise price includes the use of the yacht and its facilities, the associated natural wear and tear of the yacht and its facilities, and the ship's conduct and seafaring supervision by the skipper. There will be a cash register on board for food, fuel, harbour dues as well as lost and damaged equipment, into which each crew member will pay. The skipper is to be kept free of this cash.

TERMS OF PAYMENT & CANCELLATION

A deposit of 20 % of the cruise fee is due upon registration, the balance 21 days before the start of the cruise at the latest. The sailor can withdraw from the registration at any time. The organiser asks for immediate notification. In this case "Skook Sailing Adventure" can demand a reasonable compensation for the travel arrangements made. This is calculated as a percentage of the tour price: up to 60 days before the start of the trip: 10 %, at least 50 €; 59 to 30 days before the start of the trip: 20 %; 29 to 22 days before the start of the trip: 30 %; 21 to 15 days before the start of the trip: 40 %; 14 to 7 days before the start of the trip: 80 %; 6 to 4 days before the start of the trip: 90 %; from the 3rd day before the start of the trip/non-arrival the entire tour price. The sailor has the possibility to provide a substitute. The conclusion of a travel resignation insurance is recommended. The organizer is also entitled to withdraw from the contract at any time, if the participant does not meet his payment obligations, if the minimum number of participants cannot be reached, in case of natural catastrophes, force majeure, war, unrest or comparable events. The sailor will then receive his payments back, further claims are excluded. It is in the nature of sailing that the course of the cruise is delayed or changed by weather conditions or defects. In the event of an unreasonable delay, only the pro rata travel price will be refunded.

LIABILITY & INSURANCE

The organiser is liable within the scope of his duty of care for the conscientious preparation of the trip, the correctness of the service description and the proper provision of the agreed services. The nature of sailing trips means that not everything can be planned exactly in advance. We therefore reserve the right to make any deviations in the itinerary that may become necessary as a result of unforeseeable events. According to Magabe 651h BGB, the liability of the tour operator is limited to three times the tour price. The tour operator is not liable for damages caused by third parties or own fault or by the fact that the instructions of the skipper were not followed. Every sailor should be aware of the fact that sailing involves certain typical risks and takes part in the sailing trip and the associated activities at his or her own risk. He or she is responsible for the necessary safety measures for his or her person, such as putting on life belts and life jackets or securing on board and ashore. The undersigned exclude any liability among themselves except for intent and gross negligence, this applies to damage to life, limb, health and property of the other sailors. The ship is insured against liability and comprehensive insurance. The sailor undertakes to handle the ship and its equipment with care. In the event of damage caused by the pilot, the pilot is liable up to the amount of the excess of the insured sum. Intention and gross negligence are not insured.

SHIP GUIDING

The sailor is insured to be physically and mentally healthy, not to suffer from infectious diseases and to be able to swim. These sailing conditions do not affect the rights and duties of the skipper. The skipper is responsible for the safety and conduct of the vessel. The skipper is entitled to exclude a fellow sailor from the further course of the trip if his behaviour endangers the safety of the vessel. The sailor undertakes to take part in the on-board routine and to follow the instructions of the skipper with regard to the navigation of the vessel as well as to do everything reasonable in the event of any disruptions to performance to contribute to remedying the disruption.

LEGAL BASIS

This contract is subject to the formal law of the Federal Republic of Germany. If individual provisions of this contract are invalid, the validity of the remainder of this contract shall not be affected.
